HTC Sues Apple: The Complaint and Patents [DOC]

Earlier this morning, HTC said it has filed suit against Apple (AAPL), accusing the company of infringing on five HTC patents. Below, a copy of the suit and a list of the intellectual property at issue in it, which, frankly, pales a bit in compared with the patents in Apple’s complaint against HTC.

Sharp releases IS01 Snapdragon-Android MID developer version and SDK

While many of us were interested in the announcement a few months ago of the Sharp IS01 smartbook, with its 1GHz Snapdragon CPU, 5" capacitive touchscreen (960 x 480) with multitouch, trackball, clamshell form factor, and Android OS, the release date certainly put a damper on our excitement. A developer's version was promised in May but somehow the consumer version was said to be coming in October.

It's not. I don't know who came up with that date, but the Sharp IS01 is actually being released next month. I should be getting one then so we'll talk all about it later.

In the meantime, the developer's version (JN-DK01) became available today, along with the SDK and an Android developer's website called SH Developers Square. Developers are being asked to create 854 x 480 resolution applications using the basic Android 1.6 API and Sharp's proprietary extended API for "infrared data transfer, LED flashlight, camera, opening and closing [notifications], and file picker." They are locked out of the FM transmitter, 1Seg tuner, EVDO radio, and phone functions, some of which may not even be present at all in the unit.

The JN-DK01 doesn't come with any of the Google goodies (Gmail, Android Market, YouTube, etc.) or Sharp's apps either and is only offered in brown, so unless you plan to do all the legwork yourself and don't mind the color, then I'd suggest waiting until next month for the black or light blue IS01.

Lady GaGa is Apple iPhone 4G spokesperson: Brilliant move by Apple if rumors are true

Unconfirmed rumors that Lady GaGa will be Apple's next spokesperson are the buzz on the Internet. Of course, word of the 23-year-old star appearing in commercials for the new Apple iPhone 4G have either a love or hate effect on people.

Lady GaGa who has has sold over ten million albums and over thirty-five million singles worldwide is a big name. So is Apple.

Putting the two together, whether you like it or not, is brilliant. Those who don't like her music, or her rather eclectic look, will watch the commercial just to complain about it.

Others who are devoted GaGa fans will be happy to see her anywhere they can.

Like it or not, you'll be tuning in. Excellent marketing.

Poker Face, Telephone and Bad Romance and now Apple 4G. Interestingly enough, Lady Gaga's Monster Ball Tour starts June 28 with a total of 31 cities in the U.S. and Canada scheduled. The Apple 4G is due to debut around that time, so isn't that just perfect timing?

Whether you are a Lady GaGa fan or not, if the rumor is true that the Apple 4G commercials will feature Lady GaGa, it is an super PR move on Apple's part. She's notorious for attracting attention on the stage, the radio and in the world of social media, so it's just good business.

Time will tell...for now, Apple is keeping a poker face about the whole Apple iPhone 4G -- Lady Gaga connection.

Nokia Goes ‘Back to the Future’ in Attempt to Topple iPhone

Nokia Oyj has chosen Anssi Vanjoki, an outspoken executive who produced its last hit smartphone three years ago, to bring back the buzz.

Vanjoki, a 20-year company veteran named yesterday to take over a new smartphone unit, launched the N95 model in March 2007. That was eclipsed three months later by Apple Inc.’s iPhone. Espoo, Finland-based Nokia, the world’s largest handset maker, still hasn’t developed a phone with the same cachet.

The N95, Nokia’s first handset with GPS, sold more than 10 million units and helped boost the operating margin in devices to more than 21 percent. Since then, Apple and Research in Motion Ltd. have eaten away at Nokia’s customers and profits, driving down the margin to 12.1 percent in the first quarter.

“It’s a bit back to the future,” said Carolina Milanesi, a research director at Gartner Inc. in Egham, England. “The biggest challenge is that he doesn’t have much time, as Nokia needs to deliver.”

Shares in Nokia have lost 22 percent in the three weeks since the company reported first-quarter earnings that missed analyst estimates. Nokia slashed prices for smartphones in the period to compete with the iPhone and RIM’s BlackBerry.

Vanjoki’s first answer to the iPhone was a line of music phones in August 2007. At the announcement, he said, “If there is something good in the world, we copy with pride.” Apple has since cited that comment in an ongoing U.S. legal battle between the companies over patents used in their smartphones, with each side accusing the other of stealing their technologies.

Latest Salvo

Nokia last week filed a patent-infringement lawsuit against Apple in its latest salvo over the iPhone and iPad. The suit, the fifth patent complaint between the two companies in the past year over smartphone technology, broadens the fight to include Apple’s iPad touch-screen computer tablet.

One of two remaining members of former chief executive officer Jorma Ollila’s so-called “Dream Team” from the 1990s along with current CEO Olli-Pekka Kallasvuo, 53-year-old Vanjoki will have to defend Nokia’s position from increasing competition on all fronts, analysts said.

The company has not only lost momentum in touchscreen phones to Apple and in Qwerty-keyboard business phones to RIM, it’s also being challenged by Samsung Electronics Co., HTC Corp. and LG Electronics Inc., which have revamped their lines with Google Inc.’s Android operating system.

“The stakes couldn’t be higher,” said Tero Kuittinen, an analyst at Greenwich, Connecticut-based MKM Partners. “The iPhone is a luxury juggernaut that can no longer be defeated, but Nokia still has a shot at snuffing out the challenge of its Asian midrange rivals.”

Marketing Strategy

Nokia hired Vanjoki in 1991 from St. Paul, Minnesota-based 3M Co. to develop a mobile-phone marketing strategy and the global brand. He started running the multimedia unit in 2004, and shipped the N95 three years later in March 2007.

Vanjoki shifted back to marketing a few months later, after the phone units were merged into one devices division and Kai Oistamo was put in charge. Vanjoki will now once again head a separate smartphone business, while Mary McDowell will run the low-end phones. Oistamo will take McDowell’s corporate development job. Nokia said the executives were unavailable to comment.

Vanjoki is known for speaking his mind in a company that tends to take a more low-key approach. In February, he criticized the N97, a combination touchscreen and keyboard phone that was supposed to help Nokia take back high-end smartphones, in a video interview with the All About Symbian blog.

“The N97 has been a tremendous success for us when it comes to how many did we ship and how much money did we collect,” he said. “But it has been a tremendous disappointment in terms of the experience quality for the consumers, something we did not anticipate.”

Speeding Harley

A graduate of Finland’s biggest business school, Vanjoki is also chairman of Amer Sports Oyj, the Finnish sports equipment company that owns the Salomon and Wilson brands. He made the Finnish press in 2002 after police tried to fine him more than $100,000 for speeding through town on his Harley-Davidson.

Vanjoki’s first test in the new job will be later this year when Nokia rolls out the N8, a slim touchscreen with a revamp of its Symbian software system to make it more finger-friendly. The phone will come with free access to television content, maps and navigation.

“Anssi’s going to have the ultimate responsibility to be the poster child for these new products,” said Ben Wood, a London-based analyst at CCS Insight. “It’s a big bet and the first step of a long journey back. If these people don’t succeed, they will be doing something different in three years.”

CHICAGO and WASHINGTON -- The Software & Information Industry Association (SIIA) has announced that the Coveo Enterprise Search platform has been selected as the winner of the prestigious CODiE Awards in the "Best Enterprise Search Engine" category. The announcement came at a special CODiE Awards luncheon held this week in conjunction with the All About the Cloud conference in San Francisco.

One hundred eighty-eight products from 136 companies were selected as finalists from more than 785 nominations submitted by 374 companies. Nominated products underwent an intensive review by subject matter experts, analysts, journalists, and others with deep experience in the field. Thirty-four winners for the 2010 CODiE Awards were announced this week. A listing of winners is now available on the CODiE Awards Website at www.siia.net/CODiEs.

"It is an honor to accept our second CODiE award in the 'Best Enterprise Search Engine' category," said Laurent Simoneau, CEO, Coveo. "It is rewarding to have the CODiE judges recognize the significant strides we have made to ensure continued expansion of the use of enterprise search within the enterprise. "This is the twenty-fifth year we have recognized excellence in the software, education and information industries through the CODiE Awards program," noted Ken Wasch, President of SIIA. "In this economic climate, companies are doing even more to innovate. Coveo has demonstrated a commitment to innovation and quality that is reflected in their selection as the winner of the CODiE Award for Best Enterprise Search Engine."

Originally called the "Excellence in Software Awards," the CODiEs were established in 1986 by the Software Publishers Association (SPA), which preceded the Software & Information Industry Association (SIIA). The program was created so that pioneers of the then-nascent software industry could evaluate and honor each other's work. Telecom Managed Services Are Transforming Carrier Business Models, Pyramid Finds

CAMBRIDGE, Mass, -- Network operators are turning to managed services and outsourcing not only to reduce their operating costs but also to transform business models to compete more effectively, a trend that will continue growing, according to a new report from Pyramid Research (www.pyr.com).

Telecom Managed Services: Network Outsourcing Enters Its Third Phase analyzes the telecom managed services sector, focusing on how operators worldwide are using outsourcing and managed services from their technology suppliers to change their businesses. The 41-page report examines the impact of network outsourcing on telecom operators in developed and emerging markets and analyzes telecom managed services efforts by three major technology suppliers: Alcatel-Lucent, Ericsson, and Nokia Siemens Networks.

The telecom managed services sector is entering its third phase of development, characterized by a greater focus by operators on how to adapt to the changing dynamics of the industry and position themselves better for future opportunities, notes Elizabeth Bramson-Boudreau, Analyst at Large and author of the report. "Drivers of third-phase outsourcing include network sharing and the emergence of over-the-top (OTT) applications, such as social networking, that can, if allowed, bypass operators almost entirely," says Bramson-Boudreau.

Widespread adoption of telecom managed services will change the telecom landscape significantly in the coming decade, Bramson-Boudreau notes. As more carriers offload bigger portions of their network operations to trusted partners, telco business models will shift away from simple service provisioning, she explains. "The operator of the past – with full control over all network functions, monopolist-style attitudes toward customer service, and slow delivery of new services – is unlikely to exist in the future," she adds.

Telecom Managed Services: Network Outsourcing Enters Its Third Phase is part of Pyramid's research report series. A blend of primary research and qualitative analysis, Pyramid's research reports offer comprehensive coverage of the fixed and mobile communications space and enable those in the communications industry to stay ahead of changing market dynamics. New Common Cents Mobile Answers the Call for PAY-AS-YOU-GO Innovation With Unique Round Down™ Minutes

Sprint and Walmart launch no nonsense prepaid service with industry-leading 7-cent minutes and 7-cent text messages ideal for budget-conscious, no-frills customers.

WARREN, N.J. – Now more than ever, Americans are searching for smart and simple ways to cut unnecessary costs. Sprint (NYSE:S) and Walmart [NASDAQ:WMT] today announced the launch of Common Cents Mobile, the newest member of Sprint’s powerhouse prepaid portfolio with 7-cent minutes that Round Down and 7-cent text messages to provide the greatest value for budget-conscious consumers. The new brand, part of Sprint’s prepaid multi-brand strategy, debuts May 15 exclusively in more than 700 Walmart stores in markets such as Birmingham, Ala., Detroit, Houston, Orlando, Fla., and more.

“In recent months, consumers seeking no-frills, pay-by-the-minute plans have been somewhat overlooked with the popularity of unlimited plans in the market," said Dan Schulman, president of Sprint’s prepaid group. “These customers want to stay connected -- to a point -- but don’t want to waste time or money on services they don’t use. The addition of Common Cents combines easy-to-use handsets with a simple pay-by-the-minute service that can save them money.”

Unlimited monthly plans without contracts helped re-energize the prepaid business last year but pay-by-the-minute customers still represent the majority [63 percent] of prepaid market share, and almost half [49 percent] of prepaid gross adds.[1]

Unique new features

Round Down – Exclusive to Common Cents Mobile, Round Down minutes offer straight-forward pricing as consumers pay only for what they use – or less. The concept is simple: other carriers round up to the nearest whole minute; if you talk, for example, for 1 minute and 46 seconds, you will pay for 2 minutes for the call.

But Common Cents will “Round Down” your call of 1:46 minutes to 1 minute, allowing consumers to pay for less than what they actually use. With minutes that Round Down after the first minute, not up, consumers get more minutes for their money.

Handsets - Common Cents Mobile offers handsets with simple, basic functions – voicemail, text messaging, caller ID – that appeal to cost-conscious consumers. The easy-to-use, affordable and stylish units are priced to highlight the 7-cent-minute pricing and include the LG101® priced at just $19.77, the Samsung® M340 at $39.77, and the Kyocera® S2300 for $69.77.

Offers – Developed for consumers who seek ease and simplicity, Common Cents Mobile lets customers activate and add money to their account with two service options:

· $20 Refill card = 30 days of service, up to 565 minutes of talk

· $30 Refill card = 60 days of service, up to 848 minutes of talk

Consumers may also add unlimited messaging for $20 per month and data access for $1/megabyte per day. Adding to monthly balances is accomplished by buying Refill cards or by registering a credit or debit card or PayPal account online at CommonCentsMobile.com. With Common Cents Mobile, there are no activation or termination fees and no long-term contracts.

As part of the launch, Common Cents Mobile will introduce a new regional ad campaign and “jingle” that speaks to turning back to a simpler time, like the Common Cents Mobile plans.

Handsets and Refill cards will be available beginning May 15 at select Walmart locations. For more information or to locate a Walmart store that carries Common Cents Mobile, please visit the store locator.

About Common Cents Mobile

Powered by the Nationwide Sprint Network, Common Cents Mobile will be available at select Walmart locations and online at www.CommonCentsMobile.com and www.Walmart.com, providing the most budget-conscious consumers with more minute for their money.

HTC EVO 4G boasts the newest version of the highly acclaimed HTC Sense user experience. With HTC Sense, HTC EVO 4G users can use Friend Stream to aggregate multiple social communication channels, including Facebook and Twitter into one organized flow of updates; a "Leap" thumbnail view to easily switch between home screen "panels;" the ability to download new, interactive widgets; and a "polite" ringer, which quiets the ringing phone once lifted up.

While the performance of currently available Android applications will be enhanced by access to 4G data speeds, a Sprint 4G developer guide is available today from the Sprint ADP Web site at http://developer.sprint.com. The Sprint 4G developer guide provides details on developing for an Android 2.1 handset and how to take advantage of HTC EVO 4G's unique hardware and software capabilities and the Sprint 4G network. The Sprint Application Developer Program has been providing tools for third-party developers since Sprint first launched the Wireless Web on its phones in 2001.

Worry-Free Pricing

HTC EVO 4G will be available in all Sprint retail channels, including Sprint.com and national retail partners, RadioShack, Best Buy and Wal-Mart. Sprint will price the award-winning device at $199.99 with a two-year service agreement and after a $100 mail-in rebate (taxes excluded) with a new line activation or eligible upgrade. Pre-registration is available now at www.sprint.com/evo.

In order to provide the best experience, HTC EVO 4G will use Sprint's industry-leading Everything Data or Business Advantage Messaging and Data plans that include unlimited Web, texting and calling on the Sprint Network to every mobile in America with Any Mobile, AnytimeSM. Everything Data plans start at $69.99 per month. A $10 per month Premium Data add-on will apply allowing customers to take advantage of a richer data experience than ever before.

Additionally, an optional pricing add-on will turn HTC EVO 4G into a mobile hotspot connecting up to eight Wi-Fi enabled devices, such as laptops, gaming devices and digital cameras, simultaneously at 4G speeds where available and at 3G speeds anywhere on the Sprint 3G network for just $29.99 per month - half the monthly cost of the current Mobile Broadband plan (pricing excludes surcharges and taxes).

With the Sprint Free Guarantee, customers can take advantage of HTC EVO 4G for 30 days and if not completely satisfied, may return the device within 30 days to get reimbursed for the device purchase and activation fee, get both the early termination and restocking fees waived, and receive a full refund for the monthly service plan charges.1

Sprint Brings 4G Power to Small Businesses in Tailored, Value-Priced Packages

OVERLAND PARK, Kan. --Up to 10 times faster than 3G* - a speed at which most harried small businesses only wish they could operate. Short-staffed with increasing market demands and rivals sniping for their customers, small business owners value mobile communications speed as much as location and good word of mouth.

Sprint (NYSE:S), the first national carrier with a commercially available wireless 4G network, makes speeds up to 10 times faster than 3G a possibility for small businesses. E-mails arrive quicker, files download sooner, multiple applications stream smoother without snarling PCs, Web-browsing comes blazing fast - even videoconferencing and video streaming occur without lags and glitches.

Just as important as speed, Sprint 4G is practical, priced to buy in bundles of data to fit different small businesses needs. Today, Sprint announced 4G Mobile Broadband Connection plans tailored to small businesses - with one to five employees and more than six employees - starting at $44.99 per month, excluding taxes and Sprint surcharges (see the full lineup of plans and prices for small businesses in links at the end of this news release).

"Sprint 4G is about offering high speed and high capacity at a low cost - especially to small businesses on a budget," said Tom Shaughnessy, director-Small Business. "Sprint's 3G and 3G/4G data plans are priced with value in mind - so 4G customers get the data capacity they need at a price that works."

The availability of Sprint 4G, now in 32 markets, delivers next-generation wireless services to small businesses across the country. By the end of the year, 4G is expected to cover a population of 120 million in the United States. Sprint and its 4G partner Clearwire still expect to roll out 4G coverage this year in Boston, Cincinnati, Cleveland, Denver, Kansas City, Los Angeles, Miami, Minneapolis, New York, Pittsburgh, Salt Lake City, San Francisco, St. Louis and Washington, D.C.

"Small businesses have sophisticated needs - the same as businesses 10 times their size," said Shaughnessy. "Our small business customers tell us that embracing technology is a dollars-and-cents decision. It's all about working faster, boosting productivity, cutting costs, and, ultimately, improving profits. For small businesses, 4G makes sense."

This summer, small businesses can buy the award-winning and critically acclaimed HTC EVO(TM) 4G. The device offers an unparalleled experience on 3G and 4G. With a combination of a 4.3-inch screen, built-in kickstand, 1GHz Snapdragon processor, Android(TM) 2.1 and the hallmark HTC Sense experience, HTC EVO 4G has been named among the best handsets in 2010.

Less Than Two Weeks Remain in NASCAR Sprint All-Star Race Fan Vote

HUNTERSVILLE, N.C. – Only 10 days of voting remain as Sprint (NYSE:S) announced the updated list of top vote recipients for the NASCAR Sprint All-Star Fan Vote, which allows fans to place a driver into the field of the 2010 NASCAR Sprint All-Star Race.

As of May 11, the top 10 drivers in the Sprint All-Star Fan Vote standings (in alphabetical order) are A.J. Allmendinger, Marcos Ambrose, Greg Biffle, Clint Bowyer, Jeff Burton, Carl Edwards, Juan Pablo Montoya, Elliott Sadler, Martin Truex Jr. and Michael Waltrip.

While the list of drivers in the top 10 remains unchanged from last week, it’s still anyone’s game, as fans traditionally increase their voting frequency closer to race day. Historically, nearly half of the annual vote total has been cast during NASCAR Sprint All-Star Week, so fans still have time to help their driver gain a starting spot in the NASCAR Sprint All-Star Race at Charlotte Motor Speedway.

Voting continues until one hour before the start of the Sprint All-Star Race on Saturday, May 22. Fans can cast votes for their favorite eligible drivers using the NASCAR Sprint Cup Mobile application, by visiting NASCAR.com or at the Sprint Experience, located in the midway at every NASCAR Sprint Cup Series event.

As an incentive for Sprint customers, every wireless vote submitted from a Sprint or Nextel device counts double in the driver standings.

Last week’s Sprint customer favorites (in alphabetical order) were Clint Bowyer, Jeff Burton, Carl Edwards, Juan Pablo Montoya and Elliott Sadler.

To be eligible for the Sprint All-Star Fan Vote, drivers must be approved by NASCAR for NASCAR Sprint Cup Series competition and have met all other eligibility requirements. Those requirements include, but are not limited to, competing in a NASCAR Sprint Cup Series Championship Event during the 2009 season; finishing in the Top 50 of the 2009 NASCAR Sprint Cup Series Championship point standings; or attempting to qualify for a 2010 NASCAR Sprint Cup Series Championship event as of Feb. 15, 2010.

Less Than Two Weeks Remain in NASCAR Sprint All-Star Race Fan Vote

The driver accumulating the most votes, who also finishes the Sprint Showdown qualifying race, will earn a spot in the prestigious Sprint All-Star Race field. The Sprint Fan Vote winner will be announced immediately following the completion of the Sprint Showdown.

In addition to voting, fans can also use the NASCAR Sprint Cup Mobile application to view the NASCAR Sprint All-Star Race in its entirety on Sprint devices.

To download the new NASCAR Sprint Cup Mobile, which is free with any data plan, Sprint customers should text “NASCAR” to 7777. Votes may also be cast on Sprint devices by texting “VOTE” to 7777 (Standard text messaging and data rates apply).

Drivers eligible for the 2010 Sprint All-Star Fan Vote:

A.J. Allmendinger, Aric Almirola, Marcos Ambrose, John Andretti, Norm Benning, Greg Biffle, Dave Blaney, Mike Bliss, Todd Bodine, Clint Bowyer, Jeff Burton, Patrick Carpentier, Terry Cook, Derrike Cope, Erik Darnell, Carl Edwards, Bill Elliott, Jeff Fuller, David Gilliland, Robby Gordon, San Hornish Jr., Travis Kvapil, Michael McDowell, Casey Mears, Paul Menard, Juan Pablo Montoya, Joe Nemechek, Max Papis, David Ragan, Tony Raines, Robert Richardson, Scott Riggs, Elliott Sadler, Boris Said, Regan Smith, Reed Sorenson, Scott Speed, David Stremme, Martin Truex Jr., Mike Wallace and Michael Waltrip.
